  Source: North Carolina State Archives 19 Nov 1999 Proved in March Court of Craven County, NC YEAR--1780 “WILL” Will of OZBORN POWELL In the Name of God. Amen I, OZBORN POWELL, of the County of Craven, Planter being sick and weak of body but of sound and disposing mind, memory and understanding do make and publish this my Last Will and Testament in manner and form following that is to say Imprimis: I give, devise, and bequeath unto my loving Wife MARY, One Third Part of my Plantation or Tract of Land, on Core Creek during her natural life and also her the use and labors of my two Negroes JINSON and ZINA. Item: I give, devise and bequeath unto my Daughter MARY, One other Third Part of the said Plantation or Tract of Land and also Two Negroe Girls named AGA and AFFA, at the age of 21 or day of her marriage. Item: I give, devise and bequeath unto my Daughter MARGERY, the other Third Part of the said Plantation a Tract of Land and also One Negroe Girl named PEG to be delivered to her at the age of 21 Years or day of marriage. Yet My Will and Desire is that as to the Future ISSUES, OFFSPRING, AND INCREASE of the said girls named AGA, AFFA, and PEG the same shall be equally divided between my said Two Daughters SUSANA and MARGERY at the time aforesaid. And whereas it is supposed that my said loving Wife is issuing now, in case she should have a Boy and the same should live to the Age of Twenty One Years. It is my wish and desire that he should have all my aforesaid Plantation or Tract of Land on Core Creek and also the said Negroe Girl named AFFA together with an Equal third part or share of all the Issue, Offspring, and Increase of the other Girls, named AGA and PEG, so that all my children may receive and take their equal Third Part or Share. Of the same as soon as my Youngest Child shall attain the Age of Fifteen Years and to the end that All and Every Part of my Estate may be kept together it is my Will and Desire that the same be and remain until division thereof is made at the time aforesaid in the hand and management of my said loving Wife, for the maintenance and education of my children. Item: I give, devise, and bequeath all the rest is due and remainder of all my Estate, real and personal, is, of, hereby mentioned to be dispose of unto my said loving Wife and all my Children, to be equally divided between them at the time aforesaid/ reasonable wearing, and casualties only excepted/ and save and except my young Horse which, I give to my loving Wife. In Witness whereof I have hereby published and declared this to be my Last Will and Testament hereby revoking all former Wills by me made and hereto Set my Hand and Seal this 15 January AD 1780. OZBORN POWELL Signed, Sealed, Published, and Declared by the said Testators as and for his last Will and Testament in the presence of L.R. DEC ST LEGER MARY MORSE of J BIGGLES,JR March Craven County Court 1780: The afore going Last Will and Testament of OZBERN POWELL, Deceased was produced in Court and Duly Proved by the Oath of XXX ST.LEGER, one of the Subscribing Witness thereto who swore that he was Present and did see the Testator Sign, Seal, Publish, and Deliver. The same to be and confirm his Last Will and Testament, that at the time thereof He the Testator was of Sound, Disposing Mind and Memory. Ordered, that MARY POWELL, Widow of the Deceased have Administration with the Will annexed, she having Entered into Bond and Qualified agreeable to Law. Ordered that Letters issue accordingly.
